2021 Special Congressional Election Candidate Information

The Secretary of State is pleased to release the 2021 Special CD1 Election: Candidate Information Guide. The Guide serves as an easy-to-use reference for candidates who are seeking to fill the vacancy in the office of United States representative, in the election being held on June 1, 2021.


When to File

All Candidates will file on:  Tuesday, April 6, 2021 between the hours of 9:00am and 5:00pm, in the office of the Secretary of State (located at 325 Don Gaspar Ave, Suite 300, Santa Fe, NM  87501).


What to file

Filing as a Major or Minor Party Candidate

During a special election to fill a vacancy in the US House of Representatives, qualified political parties will nominate a candidate based on the party’s rules. Each political party’s nominee will also need to file their declaration of candidacy with the office of the Secretary of State on the fifty-sixth (56) day before the election.

Major and Minor Party Candidates will need the following forms:

2021 Special CD1 Election: Declaration of Candidacy
AND

2021 Special CD1 Election:  Qualified Political Party Nomination Form

Minor Party Candidates will also need: 

If someone other than the candidate will be filing the Declaration of Candidacy, said proxy will also need to bring a signed affidavit form (a blank copy can be found below – under “Other Forms”).


Filing as an Independent Candidate

Independent candidates fill file their declaration of candidacy and nominating petitions (signed by eligible voters residing within the congressional district), with the office of the Secretary of State on the fifty-sixth (56) day before the election. The required number of signatures needed for an independent candidate, are based on the timing between the announcement of the vacancy and the filing date to submit a declaration of candidacy. Pursuant to 1-8-51(F)(2), NMSA 1978, because there are less than thirty (30) days between the vacancy and filing date, the minimum required number of signatures for independent candidates will be 1,661. Independent candidates will need the following forms:

AND

2021 Special CD1 Election: Independent Candidate Nominating Petition – English

– AND / OR –

2021 Special CD1 Election: Independent Candidate Nominating Petition – Spanish

If someone other than the candidate will be filing the Declaration of Candidacy, said proxy will also need to bring a signed affidavit form (a blank copy can be found below – under “Other Forms”).


Filing as a Write-In Candidate

Write-in candidates will file their declaration of intent to be a write-in candidate with the office of the Secretary of State on the fifty-sixth (56) day before the election. Write-in candidates will need the following form:

If someone other than the candidate will be filing the Declaration of Candidacy, said proxy will also need to bring a signed affidavit form (a blank copy can be found below – under “Other Forms”).


Other Forms:

2021 Special CD1 Election:  Affidavit of Designee for Filing – This form is only required if the declaration of candidacy/declaration of independent candidacy or declaration of intent to be a write-in candidate are filed by anyone other than the candidate.

2021 Special CD1 Election:  Statement of Withdrawal of Candidacy – This form is only required if a qualified candidate decides to withdraw from the race, in a timely manner. Please note: Qualified candidates cannot withdraw using this form after the ballots have been certified for print.

Petition Request Form – This form is only required if a candidate is requesting copies of the nominating petitions filed by Independent candidates. Please note: Nominating petitions are only required for Independent candidates in this election; requests for petitions that are not required for this election cannot be fulfilled.
